Gift Certificate Terms and Conditions

1. GIFT CERTIFICATE TERMS AND CONDITIONS
Terms: Tickets purchased with a gift certificate are subject to Broadway.com’s standard service charge, which may equal up to 42.5% of the ticket price. Usable up to balance only at Broadway.com or 1-800-BROADWAY. Valid only to buy tickets or premium tickets for any available performance of a show playing on Broadway or Off-Broadway in New York City and sold via Broadway.com or 1-800-BROADWAY at the time of redemption, subject to ticket and performance availability. Not redeemable toward previous purchases or for gift certificates. Not redeemable for cash unless required by law. Certificates purchased with a value of $500 or more will not be redeemable until 96 hours after purchase. Purchases made with your certificate are a final sale; no refunds or exchanges. Not a credit or debit card. Not reloadable. Cannot be resold. Safeguard the certificate. Certificate may be replaced if lost, stolen or damaged, subject to cardholder providing proper verification at time of request. Call 1-800-BROADWAY to request replacement. CARDCO CCCIV, Inc. is the certificate issuer and sole obligor to certificate owner. CARDCO may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not CARDCO, will be sole obligor to certificate owner. Certificate is distributed by Broadway.com. However, Broadway.com is not an obligor to certificate owner. 2. GIFT CERTIFICATE SALES
Broadway.com offers stored value gift certificates. Gift certificates are denominated in U.S. Dollars and may be purchased in any amount between $25.00 and $1,500.00. Certificates purchased with a value of $500 or more will not be redeemable until 96 hours after purchase. All gift certificate sales are final and not refundable.

3. REDEMPTION
Gift certificates are redeemable for tickets or premium tickets to any available performance of any show sold by Broadway.com either on Broadway or Off-Broadway playing in New York City. Certificates purchased with a value of $500 or more will not be redeemable until 96 hours after purchase. All gift certificate redemptions are a final sale, which means no refunds or exchanges.

If the gift certificate holder’s final ticket purchase is less than the value of the gift certificate, the unused balance will remain on the gift certificate to be used for future transactions. The gift certificate holder can check the gift certificate balance at any time online at https://checkout.broadway.com/gift-certificates/balance or by calling 1-800-BROADWAY.

If the gift certificate holder’s final ticket purchase exceeds the value of the gift certificate, the gift certificate holder will be required to pay the difference with a valid debit or credit card in order to complete the ticket purchase.

4. LIMITATIONS
Gift certificates may not be redeemed for cash, be used or redeemed towards previous purchases or to purchase other gift certificates and cannot be resold. Gift certificates are not debit or credit cards and cannot be used as one. Gift certificates cannot be reloaded or recharged; use of gift certificates is limited to the initial face value of the gift certificate.

5. RISK OF LOSS
Safeguard the gift certificate. Gift certificates will not be replaced or replenished if lost, stolen or used without authorization.

6. EXPIRATION
Gift certificates issued on or after March 22, 2007 do not expire and no fees are charged for unused gift certificate balances. Gift certificates issued prior to March 22, 2007 expire in accordance with their terms to the extent permitted by applicable law.

7. LIMITATION OF LIABILITY
Broadway.com, its affiliates and CARDCO make no warranties, express or implied, with respect to the gift certificates, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a gift certificate is non-functional, your sole remedy, and our sole liability, shall be the replacement of such gift certificate. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you and you might have additional rights.

8. GENERAL TERMS
CARDCO CCCIV, Inc. is the certificate issuer and sole obligor to certificate owner. CARDCO may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not CARDCO, will be sole obligor to certificate owner. The terms and conditions applicable to the purchase and redemption of Broadway.com gift certificates are governed by the laws of the State of New York, without regard to principles of conflict of laws. All Terms and Conditions are applicable to the extent permitted by law.
